Definitions

The Buyer means the person who buys or agrees to buy goods from the seller.
The Seller means Hanselifter (UK) Limited.
Conditions means the conditions of sale set out in this document and any other special conditions agreed in writing by the seller.
Goods mean any products or services offered for sale by the seller from time to time.

Terms and Conditions

Our general obligations to you under the Consumer Protection (distance selling) regulations 2000 are as follows:
Generally you have the right to cancel the contract by giving notice in writing at any time during the “seven day cooling off period” and receive a full refund against your purchase. This period finishes seven working days after you receive the goods.
If you wish to cancel the contract after the goods have been dispatched and received by you, you must first notify the Customer Services Manager in writing with your decision to cancel the contract and request a “RETURN TO MANUFACTURER DOCUMENT / NUMBER” against the goods supplied.
This number must be quoted on all returned goods so that the goods can be properly identified and the refund can be processed.
The buyer will be required to return the goods to the seller before a refund can be processed.
Goods returned have to be complete and in the original packaging in a condition suitable for re-sale. Refunds will not be made against product returns which do not meet the requirements of our returns policy. The cost of returning and appropriately insuring the goods until satisfactory receipt by the seller will be Bourne by the buyer.

The seller reserves the right to make a handling and restocking charge of 25% on goods which are returned if they were ordered in error or are no longer required.

Conditions

These conditions shall apply to all contracts for the sale of goods by the seller to the buyer to the exclusion of all other terms and conditions including any which the buyer may purport to apply under any purchase order, confirmation of order or similar document.
No variation or addition to these conditions shall be effective unless agreed in writing by the seller.
Acceptance of delivery shall be deemed conclusive evidence of the buyer’s acceptance of these conditions.
Nothing in these conditions shall affect the statutory rights of the consumer.

Acceptance of Orders

No order resulting from any quotation, pro-forma invoice, price list or similar document provided by the seller shall be binding unless and until it is accepted by the seller. The seller in its absolute discretion may accept or reject any order whether on account of the product being no longer available or for any other reasons it decides.

Product Specifications

The seller warrants that the products supplied at the time of delivery will correspond to the description given by the seller. It is the responsibility of the buyer to check the compatibility and suitability of goods for any particular purpose prior to ordering. The seller reserves the rights to make without notice such minor modifications in specifications, designs, colours or materials as it deem necessary or desirable by experience. 
Prices
The price shall be that on the seller’s current list price (or if applicable, the price contained in the sellers quotation)
The seller reserves the right to revise prices prior to despatch of goods to reflect any direct or indirect increase in costs. If the seller revises the price the buyer will be informed prior to despatch and have the option to cancel the contract. If the buyer cancels the contract due to price revision any monies they have paid will be refunded in full.
All prices shown exclude VAT (unless otherwise shown) Vat will be charged at the prevailing rate at the time of despatch.
Postage and packing are shown separately and will be added to any purchase made by the buyer.
In the case of consumer sales, payment must be made in full prior to the despatch of any goods.

Despatch of goods

Buyers will be given an estimated date of despatch when placing an order. If these dates are exceeded the seller will endeavour to keep the buyer informed of the delay and a new expected delivery date. Buyers may cancel their orders prior to despatch by contacting the Customer Services Department in writing. If payment has been made a full refund will be issued to the buyer within 14 days of written receipt of order cancellation.
Whilst every reasonable effort shall be made to keep to a delivery date, all delivery dates and times are quoted as estimates only and the seller shall not be liable for any losses, costs, damages or expenses incurred by the buyer or any other person or company arising directly or indirectly out of the failure to meet any estimated delivery dates or times.

Liability

Except as may be implied by law where the buyer is dealing as a consumer, in the event of any breach of these conditions by the seller the remedies of the buyer shall be limited to damages which shall in circumstances not exceed the price of the goods purchased, and the seller shall under no circumstances be liable for any indirect, incidental or consequential damages.
Under no circumstances shall the seller be responsible for any indirect, incidental or consequential loss or damages.

Ownership and Risk

The risk in the goods shall pass from the seller to the buyer upon despatch from the sellers premises to the buyer, However, notwithstanding delivery and the passing of risk in the goods, title and property in the goods, including full legal and beneficial ownership, shall not pass to the buyer until the seller has received in cleared funds, payment in full for all goods ordered by the buyer.

Warranty and Returns

Goods supplied by the seller are covered by a manufacturers 12 month guarantee, this excludes consumables such as wheels and bearings, in the event that the buyer experiences a problem or failure with the goods purchased within the first 30 day period they should contact the Customer Services Department in writing and request a “RETURN TO MANUFACTURER DOCUMENT / NUMBER” against the goods supplied. This number must be quoted on all returned goods so that the goods can be properly identified and the repair, replacement or refund can be processed.
Confirmation of the address to return the goods will be confirmed in writing. 
PLEASE DO NOT RETURN GOODS TO OUR TRADING ADDRESS – WITHOUT THE CORRECT DOCUMENTATION IN PLACE:-
Product claims outside the initial 30 day period should be forwarded in writing directly to Hanselifter (UK) Limited in line with the manufacturers 12 month guarantee. This is supplied with the goods at the time of purchase. We strongly recommend that you retain proof of purchase and or receipt of goods to enable you to support any claims that may arise.
No contract shall be cancelled nor shall any goods, which are in accordance with the contract, be returned without the prior written approval of the seller and on terms to be determined at the absolute discretion of the seller.

Product Misuse

Should any goods malfunction as a result of abnormal environmental factors (including without prejudice to the generality of the foregoing mains power transients or dropouts, electromagnetic interference, extremes of humidity, vibration, electro-static damage, temperature, pressure or chemical corrosion then all costs incurred by the seller in repairing such equipment and investigating the causes of the malfunction shall be payable to the seller by the buyer.

Damages and Shortfalls

The buyer shall inspect all the goods purchased immediately upon delivery and shall notify the seller in writing within 7 days of delivery of any damage or shortfall to the goods ordered. If the buyer fails to do this, they are deemed to have accepted the goods and no dispute will be entered into by the seller.
The buyer shall report any damage or shortfall to the seller and the carriers in writing within seven days of delivery. Provided prompt notice of transit damage or loss is given and provided it is proved to the seller’s satisfaction that such damage occurred in transit in the UK but not otherwise, the seller will refund, repair or replace such equipment at its own discretion.

Force Majeure

The seller will not be under any liability whatsoever in the event that the seller is prevented or delayed from supplying or making delivery of any goods by any reason or cause beyond the sellers control . These events include acts of God, civil commotion, riots, flood, drought, fire, legislation or any acts by third party companies or individuals not either under contract to or employed by the seller.

No Waiver

The seller’s failure to insist upon strict performance of any provision of these conditions shall not be deemed to be a waiver of its rights or remedies in respect of any present or future default of the buyer in performance of compliance with any of these conditions.

•    Hanselifter (UK) Limited conforms to the requirements of the Data Protection Act, 1998. 
•    Hanselifter uses cookies to store information about the current shopping cart contents and to create provisional order information. Cookie information times out after 30 minutes of inactivity (session).
